Present: Ms. Saroj Tripathi, Ld. Counsel for complainant (through VC).
None for accused.
BWs issued against the accused received back unexecuted with the
report that despite efforts no information of the accused could be found. Photographs
have been annexed.
Previously, summons were served upon accused.
Let fresh BWs in the sum of Rs. 10,000, be issued against the accused
on the address filed on 30.05.2025, with one surety of like amount through the
concerned DCP returnable on NDOH, on filing of PF within two months. DCP
concerned is directed to ensure atleast three visits/ attempts are made to execute the
process and proper report be filed.
Copy of this order be sent to DCP concerned to ensure compliance.
Warrants should carry an endorsement that accused is at liberty to
settle the matter and pay the amount to the complainant by reaching out the
complainant on the no. 9871518299, in view of the judgment passed by Hon’ble
Supreme Court of India, in case titled as
Sanjabij Tari Vs. Kishore S. Borcar & Anr.,
2025 (SC)
.
In the meanwhile, considering the report received on BWs,
complainant is directed to file the fresh address of the accused/affidavit of physical
verification of address of accused.
Put up for appearance of accused/ framing of notice/ furnishing of
surety/ further proceedings on 04.06.2027.
