Fresh vakaltnama has been filed on behalf of accused. Same is taken on record.
Process u/s 82 CrPC issued against the accused received back executed. Report
perused.
An application for cancellation of the process u/s 82 CrPC moved on behalf of
accused.
It is submitted that accused could not appear as he did not receive the summonsof
this case. It is prayed that process u/s 82 CrPC issued against accused be cancelled. It is stated
that non-appearance was neither deliberate nor intentional and that he undertakes to be careful in
future.
Heard. Record perused.
Ld counsel for the complainant has prayed for imposion of the cost upon the
accused.
Considering the submissions and in the interest of justice, process u/s 82 CrPC
issued against accused is hereby stayed subject to furnishing of bail bonds and payment of cost
of Rs 2000/-.
Personal bond furnished. Same is accepted till the NDOH.
Ld. Counsel for the accused submits that complete set of documents is not
available with the accused. Ld. Counsel for the complainant submits that he shall supply the
same to the accused. Accused shall remain present on the NDOH.
Be put up for framing of notice/payment of cost/furnishing of bail bonds on
20.11.2026.
