M/S Jijau Book Sellers And Stationers Through Its Proprietor 08.04.2026 Present: Sh. Sachin, Ld. Counsel for complainant through VC. Accused proprietor is absent. None for accused. Matter is at the stage of CE. Notice was framed on the accused on 25.02.2025. Perusal shows that all 5 connected matters bearing CC NI Act No. 7230/2023, 7231/2023, 7232/2023, 7239/2023 and 7766/2023 was settled for a total amount of Rs. 1,50,661/-. Complainant side submits that out of the total settlement, only Rs. 43,500/- (in total) have been received till date for all the matters. Ld. Counsel for complainant submits that settlement was entered out of court and was payable till 15.03.2026. An MOU is stated to have been entered between the parties. On LDOH, accused side had sought time to clear their arrears. Since the accused has failed to comply with the settlement, the court is constrained to proceed the matter on merits. Accused has also failed to furnish his surety bonds of Rs. 15,000/-. Due to non compliance of court’s order, cost of Rs. 500/- is imposed on the accused to be paid to NGO for welfare of animals on the UPI id Kannananimal@ICICI. Receipt of same be filed on NDOH. Let fresh BWs in the sum of Rs. 10,000, be issued against the accused, with one surety of like amount through the concerned DCP returnable on NDOH, on filing of PF within two months. DCP concerned is directed to ensure atleast three visits/ attempts are made to execute the process and proper report be filed. Copy of this order be sent to DCP concerned to ensure compliance. Seeing the delay caused by the accused, one last and final opportunity is given to the accused side to cross-examine the complainant. PAYMENT OF COST IS PRE REQUISITE TO CROSS-EXAMINE THE COMPLAINANT. Due to absence of AR, matter stands adjourned. Put up for furnishing of surety of Rs. 15,000/- / CE on 13.10.2026.
