Accused in person.
Matter is at the stage of CE.
BWs issued against the accused received back executed at the address of Flat
no. 102 Radha Krishna residency and accused has appeared today.
Previous cost of Rs. 500/- imposed on the accused has been paid to the
NGO. Receipt shown.
Accused submits he resides at Flat no. 102, Radha Krishna Residency,
Dhankodi, Distt. Pune, Maharashtra-411043 and his no. is 9270313232.
Surety bonds of Rs. 15,000/- have not been furnished despite directions.
Today also, he has sought time to furnish the same. Accordingly, a further cost Rs. 500/- is
imposed on the accused to be paid to NGO “AB SEVA FOUNDATION SANSTHAN” on
the UPI no. 8529243603. Receipt of same be filed by NDOH.
PAYMENT OF COST IS PRE REQUISITE.
Parties had settled 5 connected matters bearing CC NI ACT 7230/2023, CC
NI ACT 7231/2023, CC NI ACT 7232/2023, CC NI ACT 7239/2023 and CC NI ACT
7766/2023 for a total amount of Rs. 1,50,661/- payable till 15.03.2026. Complainant has
received only Rs. 43,500/- (in total). Today, accused has further paid Rs. 11,000/- to the
complainant through online mode. Same is acknowledged by the complainant appearing
today. Accused has repeatedly failed to make the payment as per the settlement. Today
again, he has requested for some more time to be granted to him for payment purposes.
Same is not objected by the complainant side. Previously also, matter has been proceeded
on merits due to continuous fault of the accused. Accused is at liberty to make the payment
to the complainant side by reaching out to the complainant on the no. 9891166775.
IT IS CLARIFIED THAT THE MATTER IS BEING PROCEEDED ON
MERITS BEFORE THIS COURT.
Accused has failed to engage any counsel. In view of the same and in the
interest of justice, one more last and final opportunity is granted to the accused to cross-
examine the complainant’s witness, failing which his right for cross-examination will be
closed on NDOH. Further, accused is at liberty to make the remaining payment to the
complainant before NDOH.
Put up for verification of payment/ furnishing of surety of Rs. 15,000/- CE
with connected matters on 07.06.2027.
