Present - None.
An application has been received on the email ID of this court seeking execution of the
order of the court dated 03.06.2023 in CC No. 998/2022. The application has been filed under Civil Pro-
cedure Code and the provisions of the same are inapplicable to this court.
Vide order dated 03.06.2023 in CC No. 998/2022, this court has sentenced convict Ish-
war Singh @ Ishwar Singh Yadav to simple imprisonment for a period of six months under Section 138
of Negotiable Instruments Act, and he is sentenced to pay Rs. 43,65,000/- (Rupees Forty Three Lacs
Sixty Five Thousand Only) under Section 138 of Negotiable Instruments Act, and the same is payable to
the complainant as compensation under section 357 Cr.P.C. (The cheque in question is of Rs.
40,00,000/-. Amount of Rs. 3,65,000/- is ordered to be paid in terms of interest and Rs. 5,000/- is or-
dered to be paid as litigtion expenses by the accused to the complainant). In default of payment of the
said amount, the convict shall further undergo S.I. for a period of three months.
On application on behalf of the accused, the sentence was suspended for 30 days. How-
ever, no appeal has been filed by the convict against the order of this court.
Issue NBWs against the convict through concerned SHO on filing of PF within seven
days for next date of hearing.
