Perusal of the record reveals that an application seeking
cancellation of BW’s issued against the accused Jitender Singh has been
filed in the interregnum.
Same is perused and submissions heard thereon.
For the reasons stated therein, the same is allowed.
Bailable warrants issued against the accused Jitender Singh
stands cancelled. Accused is warned to be careful in future.
Summons sent to accused Sanjay Chakraborty have been
received back unserved with the report that when HC Sitaram Gangad, PS
Nalasopara, Mumbai had contacted ASI Ratan Singh, he had informed him

that the address of the accused had been sealed by Vasai Virar Municipality
and no person was found residing at the address given.
Perusal of the charge-sheet further reveals that the same had
been filed with a report that accused Sanjay Chakraborty had been declared
an absconder. It further reveals that even accused Mehendi Hasan had been
declared an absconder. However, today he is present in court and he has
furnished his new address ie. A-53, Adarsh Nagar, Nearby AIIMS hospital,
Rishikesh, Uttarakhand. The accused was however sounding a bit evasive
while furnishing the address. He is directed to file the address by way of an
affidavit on the NDOH.
Let copy of the charge-sheet be supplied to all accused
persons/ their counsels against due acknowledgment.
Be put up for scrutiny of the documents on 12.01.2026.
Ld. APP for the State is requested to go through the case file
before the NDOH so as to render effective assistance when this court shall
hear arguments on the charge. All accused persons are directed to remain
present in person when the arguments on charge shall be heard and no
exemption request shall be entertained. Respective counsels to also remain
present.
Copy of this order be given dasti to ld. counsel for accused
Jitender.
