Today the undersigned is also working as First Link JMFC for Ld. JMFC, NI Act-08.
Matter received by way of transfer in pursuance of order of Ld. Principal District
& Sessions Judge (Hqs), Delhi vide order no. 91487-91504/F.3(4)JMFC/Gaz./2025 dated
20.11.2025. It be checked and registered.
Present: Sh. Kamal, Ld Counsel for the complainant through VC.
Sh. Vivek Kumar, Ld. Counsel for the accused through VC.
Matter is fixed for furnishing of bail bonds and framing of notice.
Surety bonds in the sum of Rs.5000/- has not been furnished by the accused in
terms of order dated 10.01.2024.
Further, cost of Rs.500/- has not been deposited with DLSA by the accused, in
terms of order dated 27.09.2024.
On 03.02.2025, last opportunity was granted to the accused to deposit the said
cost, failing which further cost of Rs.1000/- shall be imposed upon the accused.
Since receipt regarding the payment of said cost with DLSA has not been
furnished by the accused, further cost of Rs.1000/- is imposed upon the accused for non
compliance to be deposited with DLSA, on or before NDOH.
Furthermore, no formal application for exemption from personal appearance has
been moved on behalf fo the Ld. Counsel for the accused.
Upon query, it is stated that accused is not feeling well.
However, no medical document in support of the same has been produced by the
Ld. Counsel for the accused. Therefore, keeping in view of the conduct of the accused, oral
request for exemption is disallowed.
Let NBWs be issued against the accused through SHO concerned on filing of PF
within one month, returnable for next date of hearing.
No application for cancellation of NBWs shall be entertained without proof of
advance notice to the complainant.
Put up for report/appearance/further proceedings on 07.05.2026.
