Present : Sh. Manish Yadav, Ld. Counsel for the complainant
(through VC).
These are two connected matters.
NBWs received back unexecuted with the report that
the process server met with the wife of the accused who stated that
the accused is currently out of country and she will duly intimate the
present proceedings to him. In support of the same, statement of
witness alongwith ID proof and GD entry annexed. Taken on record
in CC NI ACT/5029/2024 .
Therefore, court is of the opinion that the accused is
well aware about the present proceedings and deliberately
absconding from the clutches of law.
In these circumstances, let fresh process under Section
82 Cr.P.C/ 84 BNSS be issued against the accused, on filing of PF
within 7 days, through DCP concerned.
DCP concerned is directed to ensure that the statement
of independent witnesses is recorded at the time of execution of
warrants alongwith copy of their ID proof and the process server
appears on NDOH for recording of his statements.
Re-list the matter for 23.02.2027.
