Counsel for complainant submits that the amendment sought vide the said application does not alter the casue of action and the amendment sought is merely clerical in nature. Ld. counsel for accused objects to the maintainability of the application on the ground that the said application has not been filed by the complainant but through Ld. Counsel for complainant. In rebuttal, Ld. Counsel for complainant submits that the present application has been filed, as per the instructions of the complainant and an affidavit shall be filed in this regard on next date of hearing.
