Ld. counsel who entered appearance on LDOH for the accused submits that
he is not representing the accused in the present matter and his appearance was wrongly
marked on LDOH as ld. counsel for accused.
Heard. In view of the submissions, cost imposed vide order dt. 22.11.2024
is waived off and the appearance of Sh. Aditya Raina may not be read as representing the
accused in the present matter.
Perusal of record reveals that summons issued to the accused were received
back with the report of refusal.
In these circumstances, accused is deemed to be served in the present
matter. However, he has failed to enter appearance since 22.11.2024.
Accordingly, to enforce the appearance of accused, issue BWs against the
accused in the sum of Rs. 5,000/- with one surety of like amount to be executed through
DCP concerned.
DCP concerned is directed to ensure that multiple attempts are made for the
execution of the warrants. Further, DCP concerned is directed to ensure that the statement
of two independent witnesses is recorded at the time of execution of process and copy of
their ID card is also be taken.
Re-list the matter for 22.09.2025.
