Present: Sh. Jitendra Pradeep, Ld Counsel for the complainant alongwith complainant in
person.
None for the accused.
Matter is fixed for furnishing of bail bonds and framing of notice.
Perusal of the record shows that cost of Rs.4000/- has not been deposited by the
accused with DLSA in terms of order dated 03.02.2025.
NBWs issued against the accused received back with the report that son of
accused was found at the given address who stated that the accused has gone to Faizabad, U.P.
for the treatment of his wife.
It is evident that the accused is aware about the proceedings of the present matter
and is deliberately trying to evade the process of law.
Let NBWs be issued against the accused through DCP concerned on filing of PF
within one month from today, returnable for next date of hearing. Report on the warrants to be
also endorsed by the DCP concerned before sending the same to Court.
Complainant is at liberty to accompany the process server at the time of
execution of warrants.
Concerned process server to appear on NDOH in the event of failure to file the
report on the process on the NDOH. Copy of this order be sent alongwith warrants to ensure
compliance.
Further, DCP concerned is directed to ensure that at least three attempts/visits are
made for the execution of the process.
No application for cancellation of NBWs shall be entertained without proof of
advance notice to the complainant.
Put up for report/appearance/further proceedings on 02.02.2026.
