Accused no. 2 with Ld. Counsel Sh. Shubham Pandey. (Through VC).
Accused no. 1 is company.
Matter is at the stage of appearance of accused/furnishing of bail bonds/
framing of notice.
Ld. Counsel for the accused submits that the accused no. 2 could not
appear in the court today as they are out of station. Perusal of record shows that on the
LDOH as well, the accused had not appeared in the court to participate in the Court
proceedings. Last opportunity was given to the accused to participate in the court
proceedings, and it was mentioned that non compliance of the same shall lead to
imposition of cost on the accused no. 2. Perusal of record further shows that it has
been more than one year and that matter is at the same stage on account of non
participation on part of the accused no. 2.
In light of the above-mentioned conduct of the accused no. 2, a cost of
Rs. 5000/- is imposed on the accused to be paid to the complainant on or before
NDOH.
Previous cost of Rs. 5000/- imposed on the accused no. 2, not paid. Let
the same be also paid alongwith today’s imposed cost on or before NDOH.
Put up for purpose fixed on 17.11.2025.
Accused is directed to appear physically on NDOH.
