Accused with Ld. Counsel Sh. Suryakant. (Through VC).
Matter is at the stage of appearance of accused/furnishing of bail bonds/
framing of notice.
Previous cost of Rs. 5000/- imposed on the accused, not paid by the him
today. Let the same be paid on NDOH.
Ld. Counsel for the accused submits that due to the present being a
matter for an offence u/s 138 NI Act, the accused did not appear in the court physically
today to furnish the bail bonds and to participate in the further proceedings.
The present court being a physical Court, the accused person had to
appear physically for the above-said purpose. Nevertheless, the bail bonds are not
furnished today. The accused person is not present in the Court today and the present
Court being a physical Court, the notice on the accused cannot be framed and the plea
of guilt as well as the statement of admission/ denial of documents u/s 294 CrPC
cannot be signed by the accused through virtual mode (as the rules/SOP of Digital
Courts does not apply to the present Court).
The accused is granted one more opportunity to participate in the further
proceedings and to furnish bail bonds ; failing the presence on the NDOH, a cost of
Rs. 5000/- shall be imposed on the accused to be paid to the complainant.
List the matter for appearance of accused/furnishing of bail bonds/
framing of notice on 07.08.2025.
