Accused no. 1 is a company through accused no. 2.
Accused no. 2, Raj Tomar, Director and signatory through VC.
Sh. Shubham Pandey, Ld. Proxy Counsel for accused through VC.
Fresh Vakalatnama filed on behalf of accused. Taken on record.
NBWs issued against the accused through SHO concerned received
back unexecuted with the report that one person namely Dharmender Yadav was
found who stated that no person in the name of accused resides. His statement along
with photographs annexed.
However, despite the same accused has appeared through VC.
Ld. counsel for accused submits that he has been recently engaged in
the present matter and seeks time to file Vakalatnama.
An oral request has been made for cancellation of NBWs has been
filed by accused side. Same is considered.
In view of the facts mentioned in the application, NBWs issued against
the accused Raj Tomar is stayed till the next date of hearing, subject to cost of Rs.
1,500/- to be paid to NGO for welfare of animals on the UPI id
Kannananimal@ICICI. Receipt of same be filed on NDOH.
Accused submits that he resides at House No. F-1, Raj Nagar, Loni
Border, Ghaziabad, UP-201102 and his no. is 9811204050.
Accused/applicant has shown remorse before the court. He undertakes
to be present on each and every date of hearing.
It is submitted by accused side that they have not received the copy of
complaint and annexures. Complainant is directed to supply the same to accused
side before the next date of hearing on the no. 9899237692.
At this stage, Ld. Counsel for accused submits that accused is willing
to settle the matter. He is at liberty to reach out the complainant side for settlement
purpose on the no. 9810322535.
Accused is directed to appear in person.
No exemption shall be entertained on behalf of the accused on the
NDOH. On failure of accused to appear, warrants shall be issued.
PAYMENT OF COST IS PRE REQUISITE.
At request of accused be put up for settlement if any/ appearance of
accused/ framing of notice/ furnishing of surety/ further proceedings on 23.07.2026.
