Anil Kumar Goswami and Nitesh Goswami, Ld. Counsels for complainant with complainant. Accused no. 1 is a company. Accused no. 2, Raj Tomar, Director and Signatory is absent. Sh. Param, Intern on behalf of both the accused Intern submits that accused are appearing through VC. However VC of this is court is not working today. BWs against accused no. 2 received back unexecuted with the report that the accused has left the said address. His no. was also not available. Thereafter, father of accused was contacted who said that accused has left their residence. However, an intern has appeared on behalf of accused. He further submits he is unable to contact the main counsel or the accused. Hence his submissions that accused was present on VC cannot be entertained. He is given 30 minutes more to seek instructions from main counsel. After 30 mins (12:30) PM Present: Sh. Anil Kumar Goswami and Nitesh Goswami, Ld. Counsels for complainant with complainant. Accused no. 1 is a company. Accused no. 2, Raj Tomar, Director and Signatory is absent. Sh. Param, Intern on behalf of both the accused Intern submits that he is still not able to contact the counsel or the accused. Considering the report on BWs which have been received back unexecuted but father of the accused was informed about the proceedings, it appears that accused is deliberately avoiding the appearance before this court and concealing himself. Hence, let NBWs be issued against the accused no. 2 through the concerned SHO, on filing of PF within two months, returnable on NDOH.
