Present:- Ms. Anita Pandey Counsel for complainant (through
VC).
Accused in person with counsel.
Fresh Vakalatnama filed on behalf of accused. Be
taken on record.
Counsel for accused states that he has received copy
of complaint and annexures.
Offence being bailable, accused is admitted to Court
bail on furnishing of PB & SB in the sum of Rs. 15,000/- with
one surety of like amount. PB & SB furnished, considered and
accepted. Original RC be retained on record. Robkar be issued.
Notice U/S 251 Cr. P.C. has been framed against the
accused to which he pleads not guilty and claims trial.
This court hold that present case shall be tried as a
summon case as sentence for more than one year may has to be
passed.
At this stage, admission/denial of documents under
Section 294 Cr. P.C. done. Accused states that he will not dispute
the genuineness and correctness of cheque no. 056867,
dishonorment memo's dated 20/01/2024, legal notice dated
06/02/2024 & postal receipts.
Ld. counsel for the accused submits that he shall file
an application U/S 145 (2) of N.I. Act on the next date of
hearing. Advance copy be supplied to the complainant at least 15
days in advance before the next date of hearing.

Reply thereto be also filed on the NDOH with
advance copy to the accused.
The parties are directed to be prepared for cross-
examination of the complainant on the next date of hearing in the
event the application U/S 145(2) of N. I. Act is allowed. Both the
parties are directed to be present along with their respective
counsels.
Be put up for consideration on the application / CE
on 20/12/2024.
