The application is allowed and the proceedings u/s 82 CrPC are cancelled, subject to cost of Rs.3,000/-. Rs.3,000/- paid by the accused. The same is distributed among six newly enrolled counsels sitting in the Court today i.e., Rs.500/- each. Further, an application u/s 145 (2) has been filed on behalf of the accused. Same be taken on record. Heard. Record perused. Considering the defence taken by the accused person in the notice u/s 251 CRPC, this Court is of the opinion that a plausible defence has been raised by the accused for which he must be granted right to cross examine the complainant. In view of the same, the application u/s 145(2) is allowed. List the matter for furnishing of bail bond/CE on 28.04.2026.
