Complainant is a senior citizen.
Matter is listed for recording of statement of process server qua proceedings u.s
82 Cr. PC against accused no. 3 / framing of notice of accused no. 2 and furnishing his bail bonds.
Statement of process server regarding the execution of process against accused
no. 3 is recorded separately.
Accused no. 3 Kapil Vadher is absent despite due execution of process u/s 82 Cr.
PC. In view of the same, the accused no. 3 Kapil Vadher is declared Absconder.
Details of the accused alongwith the copy of the complaint be sent to the SHO
concerned for intimation and inclusion of the name of the accused in the list of absconders and
also for taking steps to arrest the said accused as and when he is found.
It is submitted by the complainant that the entire cost of Rs. 20,000/- stands paid
by the accused.
Notice u/s 251 Cr. PC framed qua the accused no. 2. The same is read over and
explained to the accused no. 2 in vernacular language. The accused no. 2 has pleaded not guilty.
Statement of defence recorded. Separate statement u/s 294 Cr. PC recorded.
Accused no. 2 submits that he shall be representing accused no. 1 company. Let
authority letter along with vakalatnama be filed on behalf of accused no. 1.
Put up for furnishing authority letter and bail bonds / framing of notice of accused
no. 1 company on 02/11/2026.
