Sh. Madhukar Pandey, Ld. Counsel for the accused no. 1, accused
no. 3 and 4 (through VC).
Accused no. 3 and 4 present through VC.
Matter is at the stage of bail of the accused no. 1, 3 and 4 and
framing of notice.
Ld. Counsel for the accused no. 1, 3 and 4 has filed an
application to place on record moratorium order dated 28.03.2024 passed by Ld.
NCLT, Mumbai Bench-IV.
Perusal of the application reveals that order of Ld. NCLT filed
with the application is not complete.
Ld. Counsel for the complainant submits that the matter has been
compounded between the parties and nothing remains to be paid in the present
matter.
The statement of the Ld. Counsel for complainant to this effect is
recorded separately. In view of statement of the Ld. Counsel for complainant, the
present complaint case is disposed off as compounded. In result, all the accused
persons acquitted. Bail bonds, if any, stand cancelled. Surety/Sureties are
discharged. Endorsement on documents of surety, if any, be cancelled. Original
documents of surety, if any, be returned against due acknowledgement.
File be consigned to Record Room after due compliance.
