Present : Sh. Wahaj Ahmad, Ld counsel for the complainant alongwith
complainant.
Matter is at the stage of consideration on present complaint.
Ld. Counsel for the complainant has filed fresh application for
amendment of complaint, amended memo of parties and fresh evidence by way
of affidavit. Taken on record. He further submits that liberty may be granted to
him to withdraw the earlier application filed for amendment of complaint on
15.05.2024. Heard. Allowed.
Complaint perused. It is supported by affidavit. Cognizance
taken.
Perusal of file reveals that cheque(s) got presented for
encashment and got returned dishonoured. Accused has failed to make payment
within the statutory period despite a legal notice of demand. The Complaint is
within the territorial jurisdiction of this Court and is within limitation. Enquiry
under Section 202 CrPC conducted by scrutinizing documents. Arguments on
summoning heard.
Issue Summons to ACCUSED NO. 1 SHABIM MASOOD @
SABIH MASOOD AND ACCUSED NO. 2 COMPANY PACK AND GO
VACATIONS PVT LTD. on filing of PF through all modes within 15 days on all
the addresses provided by the Complainant. Complainant shall be at liberty to
accompany the process server at the time of service of summons.
