JMFC-04.
Present: Sh. Gurdault Singh Sidhu, Ld. Addl. PP for the State.
Accused is absent.
NBWs issued against the accused received back unexecuted.
Issue process u/s 82 CrPC against accused Aman Kr. Chobe. Process be
returnable on the next date of hearing. Said process be executed;
1. By publicly reading the proclamation in conspicuous place of town or village in
which the accused ordinarily resides.
2. By way of affixation in conspicuous part of the house or homestead in which the
accused ordinarily resides or to some conspicuous place of such town or village.
3. By way of affixation in some conspicuous part of the Court.
4. By way of publication in local newspaper where the accused last resided.
The following additional directions are passed in the matter for
compliance by the process server :
(a) The said process be executed by a process server not below the rank of Sub
Inspector.
(b) Photography and Videography of the process be mandatorily conduct and annexed
alongwith the report.
(c) If the accused is believed to be absconding to avoid the service of process, the
process server is to make reasonable attempts to locate and identify the movable and
immovable property standing in the name of the accused.
(d) The process server is also directed to annex the details as well as the statement of
blood relatives of the accused, in case, they are found at the spot.
The process be directed to be executed at least 30 days before the NDOH
fixed in the matter and concerned Process Server be directed to appear on NDOH for
recording of his statement in that regard. Let court notice be issued to him to appear
before this court on NDOH. Let a copy of this order be sent along with the process to
the process server for due compliance.
Also issue notice to surety of accused to appear in person before the court
for NDOH.
