On the last date of hearing, this Court had directed
issuance of notice to the SHO concerned with directions to file a
reply, if deemed fit, and further directed the Investigating Officer
(IO) to remain present in person.
Today, it has been informed by the Naib Court that
the IO is stated to be appearing before the Hon’ble High Court
and is therefore unavailable. However, a status report in respect
of the investigation has been filed today, which is taken on
record. Copy of the same has been supplied to the Ld. Counsel
for the applicant/accused.
Upon going through the report, Ld. Counsel has
objected to its contents, stating that it does not accurately depict
the true and current status of the investigation. It is submitted that
the fact that the applicant has made repeated endeavours to join
the investigation but is allegedly not being permitted to do so,
has not been mentioned.
The Court has also perused the status report and
finds some force in the contention raised. It is observed that the
report does not clearly disclose the present status of investigation
nor clarify whether the applicant/accused ever attempted to join
investigation, especially in light of the grant of regular bail to the
co-accused Prem Chand Sharma.

In the circumstances, let the SHO concerned appear
in person for clarifications on the next date of hearing.
Copy of this order be sent to SHO concerned for
compliance.
Put up for compliance and further proceedings on
01.12.2025.
