Sh. Anjani Kumar, Ld. Counsel for accused Joginder and Sunita.
Proceedings against accused Satish Kumar already abated.
An application for stopping the proceedings is pending disposal.
Submissions heard from both the sides.
Section 258 Cr.P.C. is applicable on cases instituted otherwise than
complaint cases. Since the present matter is a complaint u/s 200 Cr.P.C., the application
is disposed of as not maintainable.
At this stage, Ld. Counsel for the accused has submitted that the accused is
willing to plead guilty for offence u/s 85G ESIC Act.
It has been further submitted that the accused Sunita Soni cannot appear in
the court and Ld. Counsel for accused be allowed to plead guilty on her behalf.
Heard. Allowed.
Vide separate entry in the STR, their plea of guilt has been recorded and the
accused persons have been sentenced to pay a fine of Rs. 500/- each and imprisonment
in the rising of the court. Fine paid. Receipt issued.
Since nothing else remains, file be consigned to record room.
