Present: Sh. Surender, AR of complainant in person.
None for accused.
AR of the complainant submits that they are unable to trace out the
address of the accused. They have filed an application for calling the bank official of
the accused bank. Taken on record.
In view of the averments mentioned in the application, same stands
allowed.
Let bank witness from accused bank be summoned through all modes
on NDOH on filing of PF within two months returnable on NDOH.
Complainant is directed to file the copy of the application along with
the requisite details for summoning the bank witness at the time of filing of PF to be
sent along to the bank witness. Copy of cheque in question be also sent along.
Bank witness is directed to bring the copy of the account opening form
to give the details of the address of the accused.
COPY OF ORDER BE ALSO SENT TO BANK WITNESS.
Previously, summons were also unserved upon accused.
In the meanwhile, complainant is also at liberty to file the fresh
address of the accused/affidavit of physical verification of address of accused.
On failure of the complainant to trace out the address of the accused,
he is at liberty to withdraw the present case.
Put up for filing the fresh address of the accused/affidavit of physical
verification of address of accused/ recording of statement of bank witness on
21.05.2027.
