Investigating Officer Devender in person.
The matter is listed for consideration. Submissions
heard. Record perused.
It is observed from the record that the Customer
Application Form (CAF) in the present matter reflects the name of one
Bhagwati, whereas the accused in the present case is Virender. Upon
query, the Investigating Officer submitted that the mobile phone in
question was being used by Virender, who is the son of Bhagwati.
However, it appears that the Investigating Officer has
not made proper efforts to get in touch with the contacts of the
proposed accused Virender to establish conclusively that it was indeed
he who was using the mobile phone in question.
In view of the above and the fact that the CAF reflects
the name of Bhagwati and not Virender, the Court is of the opinion
that further investigation in the matter is required.
Accordingly, SHO concerned is directed to take further
steps in accordance with law. It is clarified that the present
observations shall not be treated as final findings and are only for the
purpose of ensuring effective investigation. The investigation shall
proceed independently and in accordance with law.
Copy of this order be sent to the SHO concerned for
information and necessary compliance.
Put up for filing of report/further proceedings on
03.11.2025. The order be uploaded as per rules.
