The undersigned has joined this court vide order No. 16/DHC/Gaz.IIB/G
7/VI.E.2(a)2025, dated 30.05.2025.
Today, the undersigned is also working as Duty JMFC.
Present: Sh. Ruchir Batra, Ld. Counsel for the complainant.
Accused no. 1 is company (represented by accused no. 3).
Accused no. 2 & 3 directors in person.
Accused no. 4 directors is absent.
Sh. Mrityunjay Singh, Ld. Counsel for accused no. 1, 2 & 3.
Vakalatnama is filed on behalf of accused no. 1,2 & 3 alongwith board
resolution, authorizing accused no. 3 Anisha to represent accused no. 1.
Taken on record.
It is submitted by counsel for complainant that summons were served to all
accused persons in the court of Ld. JMFC05 on 02.06.2025 by process server, who had given
nothing in writing to said effect. It is submitted by counsel for complainant that summons have
been served on all four accused persons. Same has been affirmed by the counsel for accused
persons present today. However, accused no. 4 has failed to appear before this court. Let
concerned process server who served the said summons be called before this court as to why
report is not on record. Notice be issued to the concerned nazarat branch.
It is submitted by accused side that they have not received the copy of
complaint and annexures. Complainant is directed to supply the same to accused side before the
next date of hearing. Same is stated to be supplied today itself through online.
Since service has already effected on accused no. 1 company, it is a deemed
service on all the directors of accused company. Accused no. 4 is stated to be director of
accused no. 1 company in amended memo of parties.
In the meantime, let bailable warrants in the sum of Rs. 10,000/, be issued
against the accused no. 4, with one surety of like amount, through the SHO concerned, on filing
of PF within 30 days, returnable on NDOH.
Accused no. 2 Sahil Jain submits that he is residing at 261, Swayamsidha
colony, West Punjabi Bagh, Delhi, M. No. 95605554015.
Accused no. 3 Anisha submits that she is residing at GD108, 3 rd floor,
Pitampura, Delhi, M. No. 9910070899.
Be put up for appearance of accused no. 4/ framing of notice/ furnishing of
surety/ further proceedings on 25.11.2025.
