Mr. Mudit Sharma, Ld. Proxy Counsel for the accused Nitin Accused Nitin and Raghav in person. Accused Renu Kalra produced from JC from Jail No. 6/Tihar Jail (bail granted, bail bond not furnished). Matter is pending for consideration on point of charge against the accused persons. Arguments qua accused Nitin had already been heard and with respect to the remaining accused persons right to argue on charge was closed vide order dt. 13.05.2026. Record perused. As per the charge sheet, the accused persons have been charged for offence u/s 420/467/468/471/34/120B IPC. With respect to Section 467/468/471 IPC, it is important for the prosecution to show that a forged document was prepared whereas, the alleged forged documents were prepared by the accused persons in their names only and therefore, there is no forgery. The signature on the document i.e. Gift Deed which is stated to be forged has not been matched with specimen signatures obtained of the accused as there is no supplementary charge sheet qua FSL result pertaining to the signatures. Therefore, the prosecution has failed to show a prima facie case of forgery against the accused persons or using of that forged document for the purpose of cheating therefore, accused persons are discharged for offence u/s 467/468/471 IPC. However, there are specific allegations of cheating by selling properties which were either non-existent or which did not belong to the accused persons in furtherance of their common intention. Therefore, a prima facie case against all the accused persons for cheating with common intention/with prior meeting of mind is made out. Hence, the accused persons are charged for offence u/s 420/34/120B IPC. Re-list the matter for formal framing of charge on 02.07.2026 (Ms. Rashi Raheja) JMFC-13, Central/THC Delhi/04.06.2026 -- 1 of 1 --
