Mr. Mudit Sharma Ld. Proxy Counsel for the accused
Nitin.
Let court notice be issued to the concerned jail
superintendent to show cause as to why accused Renu Kalra was not
produced from JC returnable on NDOH.
Last opportunities given to the remaining accused persons
for arguments on charge have not been availed by the accused as it is
submitted by Ld. Counsel for the accused persons that she will not be
able to argue as she has not received instructions from the accused.
Ms. Shivani Goyal Ld. LADC appeared for the accused
on 09.03.2026, however, on enquiry it was submitted by the accused
that some private counsel has been appointed for her because of which
Ld. LADC was not appointed to represent the accused with respect to
the present trial.
Perusal of the record shows that one of the accused is in
JC and already 04 last opportunities have been granted to the
remaining accused, therefore, no reasonable ground is made out to
grant another opportunity. In view thereof, the right of remaining
accused persons to argue on charge is hereby closed. However, in the
interest of the justice, 01 week’s time is hereby granted to the
remaining accused persons for filing written arguments on charge.
Arguments on charge qua accused Nitin have already
been heard. Arguments on charge qua the remaining accused persons
heard on behalf of the State.
Accused Raghav and Nitin are directed to remain
physically present on NDOH.
Re-list the matter for order on charge/ FP on 04.06.2026.
