Present: Ms. Parul Bhola, Ld. Counsel for complainant.
None for accused.
NBWs issued against the accused received back unexecuted with the
report that family member of accused namely Shyam Singh was found who stated
that accused has gone out of station. His statement along with photographs is
annexed.
Previously, BWs were executed against the accused but he still failed
to appear.
Accordingly, it is inferred that accused is deliberately avoiding
appearance before this court.
Let NBWs be issued against the accused through the concerned DCP
returnable on NDOH, on filing of PF within two months. DCP concerned is directed
to ensure atleast three visits/ attempts are made to execute the process and proper
report be filed.
COPY OF THIS ORDER BE SENT TO DCP CONCERNED TO
ENSURE COMPLIANCE.
Warrants should carry an endorsement that accused is at liberty to
settle the matter and pay the amount to the complainant by reaching out the
complainant, in view of the judgment passed by Hon’ble Supreme Court of India, in
case titled as
Sanjabij Tari Vs. Kishore S. Borcar & Anr., 2025 (SC)

Put up for appearance of accused/ framing of notice/ furnishing of
surety/ further proceedings on 10.06.2027.
