Present: Complainant in person.
Sh. Rakesh Kumar, Ld. Counsel for complainant (through VC).
Accused in person.
Matter is at the stage of DE.
BWs issued against the accused received back executed and he has
also appeared today.
Complainant submits that till date he has received Rs. 90,000/- out of
the total settlement of Rs. 2,20,000/- payable till January, 2026.
Surety bonds of Rs. 20,000/- have not been furnished despite
directions. Today also, he has failed to appear. Accordingly, a cost Rs. 1,000/- is
imposed on the accused side to be paid to NGO for rescuing animals in flood
affected areas of Assam on the UPI id: jbfind9818@barodampay. Receipt of same is
shown.
Since the accused has failed to make the entire payment as per the
settlement, let matter be proceeded for DE.
No application has been moved on behalf of accused to lead DE.
In the interest of justice, one more last and final opportunity is granted
TO ACCUSED TO LEAD DE, failing which his right will be closed.
Accused is at liberty to move an application to lead DE along with list
of witnesses before the next date of hearing with an advance copy to the
complainant atleast 5 days before the NDOH on the no. 9891089184.
IT IS CLARIFIED THAT NO FURTHER OPPORTUNITY WILL BE
GIVEN TO THE ACCUSED.
Accused has sought some more time to make the remaining payment
till February, 2026. He is at liberty to reach out the complainant for the same on the
no. 9891089184.
In case of failure of payment by NDOH, last opportunity will be given
to the accused to lead DE and his right will be closed.
Accused has been apprised of his right to avail legal aid services.
Complainant submits that on receiving the remaining payment of Rs.
1,30,000/-, matter shall be withdrawn.
Put up for verification of payment/ DE/ furnishing of surety of Rs.
20,000/- on 16.03.2027.
