The counsels for the accused persons have in unison have stated that the essential ingredients qua the offence u/S 318 (4), 319 (2) and 336 BNS are not made out and they have drawn the attention of the court towards various aspects in the chargesheet stating that most of the offences are not made out especially the non-bailable offences and the accused persons are languishing in custody since November 2024 and some of the accused persons were granted bail and no purpose would be served by keeping the accused persons behind the bars as only bailable offences are made out against them.
