Keeping in account the submissions made by the counsels
and the pertinent issues/aspects brought to the attention of the court
with respect to the offences in question, merits careful consideration
and which may take some time as clarifications are also required from
the IO qua the same. However, taking into consideration the period of
detention undergone by the accused persons and the fact that there are
no public witnesses as such, which may result into influencing the
witnesses and only the gravity of offence cannot be taken as a sole
criteria as on date. Therefore, I am of the opinion that no useful
purpose will be serve by keeping accused persons behind the bars.
Accordingly, accused Nand Kishore, Anand Jain, Rohit Aggarwal and
Sanjay Bansal are admitted to bail as any further custody will only act
as punitive punishment. Accused persons are directed to furnish bail
bonds in the sum of Rs. 40,000/- each with each surety of the like
amount subject to the condition that they will appear before the court
on each and every date of hearing.
Bail bonds not furnished.
Be put up for further arguments on the point of charge on
05.05.2025.
Notice be issued to the IO to remain present for the assistance
of the Prosecutor as well as arguments.
Copy of order be given dasti.
