Present: Ld. Counsel Mr. Ronak Satpati for the applicant.
Plaintiff has filed application for refund of the court
fees in view of the fact that matter has been referred to arbitration.
I have perused the application as well as the order
dated 24.05.2024 vide which the parties were referred for arbitration
on application u/s 8 of Arbitration and Conciliation Act filed by the
defendant.
Section 16 of the Court Fees Act provides for refund of
the court fees where the court referr the parties to the suit to any one
mode of settlement of dispute referred in section 89 of CPC.
Accordingly, the application is allowed. Ahlmad is
directed to issue certificate for refund of the court fees to the
plaintiff. Application stands disposed off accordingly.
