with the fact of pendency of the present suit.

already been filed therein.
In these circumstances, the Court is of the opinion that
present suit if admitted will tantamount to staying the proceedings before
Ld. ARC and especially when the Ld. ARC is seized of the matter w.r.t
Leave to Defend application already stand filed therein by the plaintiff.
