Present : Sh. Binay Kumar, AR of the complainant
company.
Accused are yet to be summoned.
During hearing, it reveals that the present case
pertains to impugned bill dated 30.10.2024, due on
14.11.2024 and printed date 14.11.2024, for a sum of Rs.
91,482/-, raised on the basis of raid conducted on 29.10.2024
by the officials of complainant company and consequently,
the present case has been filed on 24.12.2024.
It is further submitted by the AR for the
complainant company that the present matter has already
been settled before PLA on 25.04.2025 for a total sum of Rs.
10,000/- payable upto 20.06.2025, out of which Rs. 2,000/-
has already been paid by the accused persons and accused
persons have defaulted in making payment of the remaining
settlement amount. It is further submitted that clause with
respect to compounding the offence u/s 152 of Electricity Act
has not been incorporated in settlement order. It is also
submitted that no execution petition has been filed in respect
to the recovery of the settlement amount till date. Copy of
PLA order filed.
Heard. Record perused.
As per section 223(1) proviso (1) BNSS, 2023,
cognizance of the offence can only be taken after giving the
accused an opportunity of being heard.

Matter is fixed today for the purpose of pre-
summoning evidence but before proceeding further, it would
be appropriate to issue notice as per section 223(1) proviso
(1) BNSS, 2023 to the accused persons.
Accordingly, issue notice to the accused persons,
through SHO concerned and in addition dasti be given, on
filing of PF within seven days from today, returnable for the
next date of hearing.
Copy of complaint be also filed along with PF.
Put up for report on the notice on 31.07.2026.
