Present : Sh. Binay Kumar, AR of the complainant
company.
None for the accused.
Notice as per section 223(1) BNSS, 2023 has
already been served upon the accused but accused has failed to
appear despite service of notice and as such, opportunity of
accused of being heard was closed vide order dated 29.04.2026.
On being enquired, it is submitted by the AR for the
complainant that the present matter has been settled before the
office of complainant under PCC scheme on 17.03.2026 for a sum
of Rs.13,303/- out of which only Rs.1,000/- has been received and
accused has defaulted in making the payment. Copy of settlement
order filed.
Matter is fixed today for the purpose of pre-
summoning evidence.
Statement of Sh. Binay Kumar – AR for the
complainant company recorded as CW 1.
Affidavit in evidence of CW 2 namely Sh. Subhendu
Sekhar filed. He has been examined as CW2 and discharged.
Pre-summoning evidence closed by AR of the
complainant company vide his separate statement recorded today
in this regard.
Complainant is at liberty to file originals of the
documents marked today in the pre-summoning evidence.
Put up for arguments on the point of summoning on
07.10.2026.
