its renewal request has been sent to concern.
Present: Sh. Rajiv Ranjan, Ld. Counsel for the counter
claimant.
Sh. Lakshay Sharrma, Ld. Counsel for the defendant
in counter claim.
Pleadings are complete. The same are perused.
On the basis of pleadings of the parties, following issues are
framed for trial:-
1. Whether the counter claimant is entitled for a
decree of recovery from the defendant as prayed
for? OCC
2. Whether the counter claimant is entitled for
recovery of any interest from the defendant as
prayed for? If yes, at what rate and for which
period? OCC
3. Relief.
No other issue arises or is pressed upon.
It is ordered that evidence shall be recorded at one
place i.e. in main matter bearing CS No. 447/2023 titled as
“Faisal Khan Vs. Mohd. Nadeem” and copy of the same be also
placed in this counter claim and shall be read in evidence.
Put up for Counter Claimant’s Evidence on
29.05.2026. Both the parties are directed to file their list of

witnesses within fifteen days from today with copies to each
other. Counter claimant is directed to file evidence by way of
affidavits of witnesses with directions to supply advance copy
thereof to the other side under acknowledgment, at least a week
before the next date of hearing.
