Mohit Aggarwal, Ld. Counsel for the plaintiff. Sh. Asad Qureshi, Ld. Proxy Counsel for defendant through VC. Case is at the stage of PE. Adjournment sought by proxy counsel for the defendant stating that main counsel has gone to hospital and he had an appointment at 8:30 AM in the morning. It is 12:15 PM now. Moreover, perusal of the vakaltnama filed on behalf of defendant reflects that there are more than one counsels for the defendant. Even on the last date of hearing, adjournment was sought by the defendant. Ld. Counsel for the plaintiff submits that as they were informed yesterday that the defendant will be taking adjournment today, therefore, PW 1 is not present. It is also stated that if the court will direct PW1 will come for tendering his evidence in15 minutes. This court has no hesitation to put it straight on record that the defendant is delaying the matter. However, as adjournment is being sought on personal health difficulty of the counsel, this court is inclined to grant the same. Matter is adjourned Put up for PE on 04.12.2025 as last opportunity.
