It is submitted by the Ld. Counsel for the defendants no.
1 and 2 that they will be filing their Written Statement during the
course of the day alongwith the application for condonation of delay
and hard copy will be also placed on record accordingly. Further, as
per defendant no. 1, advance copy has already been supplied to the
plaintiff.
Defendant no. 2 also undertakes to supply the copy of
the Written Statement alongwith the application for condonation of
delay to the plaintiff.
At this stage, Ld. Counsel for the plaintiff has prayed
that his application under Order XXXIX Rule 1 and 2 read with
Section 151 CPC be disposed off. Both the defendants seeks some
time to file reply to the above mentioned application.
At request, be put up for filing of Written Statement
along with appropriate application for condonation of delay, reply to
the above mentioned application as well as consideration on the
application under Order XXXIX Rule 1 and 2 read with Section 151
CPC on 12.03.2026.
Date is given as per convenience of Ld. Counsel for the
