No replication filed by the plaintiff to the WS of the
defendant nos.1 & 2.
Ld. Counsel for the plaintiff seeks some time to file
replication.
Let the same be filed positively on or before NDOH.
It has been submitted by the Ld. Counsel for the
defendant that she has filed a written statement, Application on behalf
of defendant no.3 under Order 8 Rule 1 r/w Section 151 CPC for
condonation of delay in filing of written statement with affidavit, fresh
vakalatnama and proof of service online on 12.05.2026 and that hard
copy was also filed in court on 13.05.2026.
Heard. Perused. The same is not on record.
Reader is directed to trace out the same and put on
record on NDOH.
At this stage, Ld. Counsel for the defendant no.1 submits
that he will file application under Order VII Rule 11 CPC as the suit
is not maintainable.
Heard. Application, if any be filed on or before NDOH
with advance copy to the opposite side.

At this stage, adjournment has been sought on behalf of
the Ld. Associate Counsel for the plaintiff on the ground of non-
availability of main counsel owing to his ill health. Same is not
opposed by the opposite counsel.
