The present appeal has been preferred challenging
the order dated 12.11.2025 whereby the objections filed by the
appellant herein have been dismissed.
The appeal is accompanied by an application for
stay of the execution proceedings.
Heard.
Keeping in view the facts and circumstances, it is
ordered that the execution proceedings shall remain stayed,
subject to deposit of Rs.15,000/- by the appellant towards user
charges from the date of eviction order. In future, appellant will
pay this amount each month on or before 10th of English calender
month before the Ld. ARC and the same be not released to the
respondent till the disposal of the present appeal.
Issue notice of the petition to the respondent on
filing PF and RC, within seven days from today, for 07.01.2026.
Copy of the order be sent to Ld. Trial Court and be
also given dasti, as prayed.
