Present: Sh. Niranjan Rai, Proxy Counsel for the plaintiff.
Heard. Perused.
Issue summons of the present suit and notice of the application under Order
XXXIX Rule 1 & 2 CPC upon the defendant on filing of PF, RC & Speed Post.
Keeping in view the fact that the plaintiff has claimed himself to be the
absolute owner of the suit property by virtue of the reliquishment deeds having been
executed in his favour, who all are the sons and daughters of Smt. Kamla Kumari
Burad (Jain) w/o Late Sh. Punam Chand Jain, who was the absolute owner of the suit
property and the defendant in reply to his legal notice has claimed to be in adverse
possession of the suit property, the plaintiff has been able to show a prima facie case in
his favour, in whose favour the balance of conviencne clearly lies and who stands to
suffer irreparable loss and injury in case any third party rights and interest are created
in respect of suit property, the defendant is restrained from transferring the possession
or creating third party rights and interest in the suit property as shown in the site plan
i.e. one room on the first and second floor together with open space upon the second
floor till the NDOH.
Let compliance of the provisions of Order 39 Rule 3 CPC be made
within 03 working days from today.
