present suit with liberty to file afresh before appropriate court.

Further, an application under Order 13 Rule 9 CPC also
stands allowed. The original documents be handed over to the plaintiff
after keeping the certified copies on record.
Court fees so filed be adjusted as and when, if so, any fresh

Accordingly, the present suit is disposed of as withdrawn in
