Order Details: COPY OF JUDICIAL PROCEEDINGS
Pdf Text: Execution (Comm.) 588/25
BANK OF BARODA Vs. M/S DIVINE SUTRA PROP
SUSHANTJEE
13.12.2025
Present: Ms. Chitra Malhotra, Ld. Counsel for DH
through VC.
Report of Nazir has been perused and it is reported
that there is no stay against the decree under execution in this
petition and it is also found specifically stated in execution
petition that no appeal was filed by JD against the judgment and
decree under execution. Moreover, it is seen that it was an ex-
parte decree passed in favour of plaintiff/DH and against the
defendant/JD.
It has been observed that four different addresses of
JD are on record and out of these, first, third and fourth addresses
falling within the jurisdiction of West Delhi and second address
is of Bihar. The execution petition is also found accompanied
with an application seeking issuance of a transfer certificate for
the courts at West Delhi.
Hence, in view of the above fact and further since
JD is stated to be not residing, carrying on business or working
for gain within the jurisdiction of this court, the application is
allowed and the decree under execution in this petition is directed
to be transferred or sent for execution to the court of Ld.
Principal District & Sessions Judge, District West, Tis Hazari
