Present: Sh. Maharaj Singh, Ld. Counsel for plaintiff alongwith
plaintiff.
Sh. Siddharth Malik, Ld. Counsel for defendant (through
VC).
Defendant in person.
The defendant has filed on record an FDR of remaining
amount of Rs.1,00,000. Same be kept safely by the Ahlmad.
2. Ld. Counsel for the plaintiff states that he has not been
supplied copy of the affidavit of admission/denial of documents by the
defendant. Now, he is allowed to take photographs of the said affidavit
through his mobile phone. Same has been done.
3. Replication alongwith some salary slip has been filed on
record. On query, it is disclosed that same has been filed in view of the
grounds taken in WS. Accordingly, same is made by part of pleadings.
Plaintiff states that she will file affidavit of admission/denial of
documents with 15 days and issue may be framed to expedite the case.
Accordingly, same be done in the meantime.
4. From the pleadings of the parties, following issues arise:

(i) Whether the plaintiff is entitled to recovery of suit
amount of Rs.20,00,000 as prayed? OPP
(ii) Whether the plaintiff is entitled to
pendente lite and
future interest as claimed? OPP
(iii) Whether the suit of the plaintiff is liable to be
dismissed? OPD.
5. No other issue arose or pressed for. This court suggested Ld.
Counsel for the parties for appointment of Local Commissioner for
recording of evidence as per Order 18 Rule 4 CPC for expeditious
disposal of the case to which plaintiff agreed. Accordingly, vide my
separate order a Local Commissioner is appointed for recording of
evidence of plaintiff. Plaintiff is directed to file list of witnesses along
affidavit in evidence before this court in the meantime with advance copy
to the opposite counsel.
6. Put up for recording of PE before Ld. LC in the court room
of undersigned on 21.08.2025 at 2.00 PM. Put up before this court on
same date after recording of evidence. Copy of the order be given dasti.
