None for defendant despite repeated calls.
Perusal of file shows that as per report dated
18.04.2026 on process to the defendant for 20.04.2026, defendant
was served through his son namely Ashkhan Farooqi.
As per report of Ahlmad, written statement not
received till date and maximum extendable period of 120 days
expired on 16.08.2026.
Right of defendant to file written statement is stated
to be closed vide order dated 21.07.2026.
Since right of the defendant to file written statement
has been closed, hence, admission-denial of documents has not
been conducted.
From the pleadings of the suit and in view of
submissions made, following issues are framed :
1) Whether this Court has territorial
jurisdiction to try and entertain the
present suit ? OPP
2) Whether the plaintiff has supplied any
material/goods to the defendant as
claimed? OPP

recovery of Rs.38,43,958/- as claimed

No other issue arises or is pressed upon.
