M D Riyaz, Ld. Counsel for the defendants no. 1 to
3 alongwith defendants no. 1 and 2.
Ten summons were issued on the last date of
hearing.
D1, D2, D3 have been duly served on 11.12.2024.
D5 to D8 and D10 have been duly served on 05.12.2024. D9 has
been served through whatsapp on 05.12.2024.
D4 could not be served. Perusal of the report says
that no such person resides on the given address.
Fresh vakalatnama filed on behalf of defendants no.
1 to 3. Same be taken on record.
Let fresh summons of the suit alongwith notice of
the application be issued to defendant no. 4 on filing of PF, RC,
Speed Post by the plaintiff. Plaintiff is at liberty to accompany
the process server. Dasti summons as prayed.
Process server is directed to take three attempts for
the service of summons upon the defendant no. 4 and in case of
deliberate refusal, the same may be served by way of affixation.
Served defendants are directed to file WS within
time stipulated by law with advance copy to the opposite side.
Put up for reply and arguments on the application
under Order 39 Rule 1 and 2 CPC, appearance of remaining
defendants, written statements on behalf of the defendants,

replication and completion of proceedings on 20.01.2025.
All the parties are directed to maintain status quo
with respect to the suit property till the next date of hearing.
