Pursuant to issuance of warrants of attachment bankers cheque bearing no
067651 dt 29.05.2024 has been received by the court for an amount of Rs 1274228/- in
terms of order dt 13.12.2023.
Proxy counsel for the JD submits that despite intimation to the department no
instructions have been received by the counsel for the JD.
In view of the facts and circumstances let the bankers cheque received by the
court be released to the DH against due acknowledgement and upon recording the statement
of the DH that the said amount constitute full and final principal amount in terms of order dt
13.12.2023.
The DH would further certify in the aforesaid statement that he has not
received any amount in any other proceedings arising out of order dt 13.12.2023 in LC No
2137/19 against the JD and also that he would indemnify the JD in case of any excess
payment and also a statement that in case any of the statement recorded by the court is
found to be untrue he shall be liable for committing the offence of perjury upon the court.
The parties are directed to place on record calculation sheet showing the
calculation of amount of interest awarded and outstanding under the order dt 13.12.2023.
It is made clear that in case no calculation sheet is filed by the JD then the
calculation as provided by the DH would be accepted and warrants of attachment would be
issued in terms of the calculation placed on record by the DH.
Re-notify the matter for further proceedings on 30.08.2024.
