Bail Matters No. 2035/2026
STATE OF DELHI Vs. SHIVA MEHTO
E-FIR No. 80049743/2026
PS: Railway Sarai Rohilla
30.09.2026
This is an application for grant of regular bail to the
applicant/ accused.
Present:- Mr. M.A. Khan, Ld. Addl. PP for the State.
Sh. S.K. Arya, Ld. Counsel for the applicant/
accused.
IO ASI Bane Singh in person.
The IO submits that since the complainant has not
seen the face of the applicant/ accused, getting the TIP
proceedings is of no use.
Fresh report filed.
As per the IO, the charge-sheet has already been
filed, recovery has already been affected and that the applicant/
accused has no prior involvement.
Ld. Addl. PP for the State on the other hand has
opposed the bail on the ground that the allegations are grave and
serious in nature. It is argued that the applicant/accused, allowed
to be at large may induce the witnesses and may escape the
process of law.
Having heard the submissions and having perused
the record, this court is of the considered opinion that the
applicant/ accused does deserve the benefit of bail, since the
recovery has already been affected and the charge-sheet has also
already been filed, no purpose would be served by keeping the

applicant/accused behind the bar. His clean record in the past
further inspires the confidence of the court. In view of the facts
and circumstances, this Court deems appropriate to grant bail to
the applicant/accused, on furnishing a personal bond for a sum of
INR 10,000/- with one surety of the like amount, subject to the
satisfaction of the concerned court/Duty JMFC, on the following
conditions:
a. The Applicant shall cooperate in
any further investigation as and when
directed by the concerned IO;
b. The Applicant shall not directly or
indirectly make any inducement, threat or
promise to any person acquainted with the
facts of the case or tamper with the
evidence of the case, in any manner
whatsoever;
c. The Applicant shall under no
circumstance leave the country without the
permission of the Trial Court;
d. The Applicant shall appear before
the Trial Court as and when directed;
e. The Applicant shall provide the
address where he would be residing after
his release and shall not change the
address without informing the concerned
IO/ SHO;
The State is at liberty to file the cancellation of the
bail of the accused/ applicant, if he violates the conditions of the
present bail order.
-- 2 of 3 --
Needless to state, any observations concerning the
merits of the case are solely for the purpose of deciding the
question of grant of bail and shall not be construed as an
expression of opinion on the merits of the case.
A copy of the order be sent to the Jail
Superintendent for information and necessary compliance.
With the foregoing directions, the present
application is disposed off.
Copy of this order be given dasti, as requested.
