for the plaintiff.
Present suit has been filed by the plaintiff against the defendant
for recovery of Rs. 1,22,51,097/- alongwith pendente lite and future interest
@ 18% p.a.
The suit is accompanied by statement of truth and court fees.
The suit is also accompanied by application under section 12-A of
Commercial Courts Act r/w section 151 CPC seeking exemption from pre-
institution mediation and application under order XXXIX Rule 1 and 2 r/w
section 151 CPC.
Heard.
Issue summons for settlement of issues and notice of the above
applications to the defendant through e-mail, Whats App, as well as by
ordinary process, Speed post and approved courier, returnable for
29.10.2026, subject to filing of PF/RC, deposit of necessary charges within
10 days, directing the defendant to file written statement/reply within
statutory period.
